By accessing or using the PodBanter website, web studio player, mobile web interface, APIs, or private RSS feeds (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

2. Eligibility & Account Security

You must be at least 16 years of age or the age of majority in your jurisdiction to open an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Subscriptions, Payments & Cancellations

• Billing Cadence: Paid subscriptions (Listener and Pro Scholar) are billed in advance on a recurring monthly or annual basis via supported payment methods including major credit/debit cards, Apple Pay, Google Pay, and PayPal.
• Cancellation: You may cancel your subscription at any time directly from your Account Settings. Upon cancellation, your access remains active until the conclusion of your current billing period, with no subsequent renewal charges.
• Fair Usage Policy: Pro Scholar tiers provide high-volume generation subject to standard fair use guidelines (up to 60 long-form episodes per month) to prevent programmatic abuse or denial of service to other listeners.

4. Acceptable Use Policy

You agree not to use PodBanter to generate, synthesize, or distribute:

• Defamatory, fraudulent, or harassing content targeting real private individuals.
• Content promoting hate speech, violence, or illegal activities.
• Automated bot attacks, unauthorized scraping, or reverse engineering of proprietary audio pipelines.
• Infringing content violating the intellectual property or copyright of third parties without license or fair-use exemption.

5. AI Generation Disclaimer

PodBanter uses advanced multi-turn conversational AI models to analyze source documents and generate witty dialogue banter. While our systems strive for factual fidelity to the provided source text, AI co-hosts may occasionally exaggerate, humorously mischaracterize, or extrapolate concepts for comedic effect. Generated audio is provided for educational and entertainment purposes and should not be construed as legal, medical, or financial counsel.

6. Limitation of Liability

To the fullest extent permitted by applicable law, PodBanter AI Inc. and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of or inability to use the Service.
